Important amendment notice regarding contact rights of parents who share parental responsibilities but live separate during the lockdown period


Effective: 7 April 2020

Children of parents who share parental rights and responsibilities but live separate, may unfortunately not be moved between the respective parents’ houses during the lockdown period 

EXCEPT where arrangements are in place for a child to move from one parent to another, in terms of
• A court order; or
• Where a parental rights and responsibilities agreement or parenting plan, registered with the family advocate, is in existence,

provided that, in the household to which the child is to move, there is no person who is known to have come into contact with or is reasonably suspected to have come into contact with a person known to have contracted COVID-19, or reasonably suspected to have contracted COVID-19.
The parent must have the court order or agreement in his/her possession while transporting the child, or a certified copy of the court order or agreement.
